Terms of Service

These Terms of Service (the “Terms”) govern access to and use of Anchor. By creating an account, signing in, or booking a session through an Anchor-powered page, You agree to be bound by these Terms. If You do not agree, do not use the service.

1. What Anchor is, and isn’t

Anchor is a software-as-a-service product that helps independent therapists in India accept bookings and track session payments. It is not a clinical-records system, a marketplace that introduces clients to therapists, a payment processor, or a medical device. The therapeutic relationship between a Therapist and a Client is solely between those two parties; Anchor is not a party to it and does not provide therapy, advice, or recommendations.

2. Definitions

  • Anchor, we, us, our — the proprietorship operated by Shiven Kumar and the software product served at tryanchor.in.
  • Therapist — an independent practitioner who has signed up for an Anchor account.
  • Client — a person who books a session through a Therapist’s Anchor-powered page.
  • You, Your — whichever of the above categories applies to the reader at the relevant time.
  • Service — the Anchor product, including the website, dashboard, public booking pages, and any associated email communications.

3. Eligibility

The Service is offered to independent therapists, counsellors, and mental-health practitioners. By signing up as a Therapist, You represent and warrant that You:

  • are at least 18 years of age;
  • are legally permitted to provide therapy or counselling services in your jurisdiction;
  • are using the Service in connection with a bona fide professional practice; and
  • have provided accurate information at sign-up.

Anchor may, during private beta, request reasonable verification of the above representations and may decline an account if they are not met.

4. Therapist responsibilities

If You sign up as a Therapist, You agree to:

  • conduct yourself in accordance with the professional standards applicable to your practice; Anchor does not review the content of sessions and makes no representations about the quality of any therapy delivered through the Service;
  • keep your availability, fees, contact details, and other public-facing information accurate and up to date;
  • obtain your Clients’ informed consent before entering their personal data into Anchor, including informing them that their name, email, and (where applicable) phone number will be stored by a third-party service provider operating Anchor;
  • where a Client is a minor, obtain verifiable consent from the minor’s parent or lawful guardian before recording the minor’s personal data, as required by section 9 of the DPDP Act;
  • report any income recorded in Anchor to the appropriate tax authority. Anchor does not file taxes or generate statutory financial returns on your behalf.

5. Client responsibilities

If You book a session as a Client, You agree to:

  • provide an accurate name and email address; your Therapist relies on these to confirm and reach you about the booking;
  • treat the private ledger link sent at the time of booking as confidential, since anyone with that link can view your sessions and payment status with the issuing Therapist;
  • direct any disputes about cancellation, rescheduling, or payment to your Therapist in the first instance. Cancellation and payment terms are set by each Therapist; Anchor is not a party to those terms and cannot enforce or refund them.

6. Our commitments

Anchor commits to the following in operating the Service:

  • Reasonable availability. Anchor targets monthly uptime in excess of 99% but does not guarantee uninterrupted operation. Planned maintenance will be communicated where practicable.
  • No data sale. Anchor will not sell, rent, or share Your personal data with any third party for advertising or marketing purposes.
  • No revenue share on session fees. Anchor’s revenue model is, and will remain, a flat subscription fee paid by Therapists. Anchor does not and will not take a percentage of any individual session fee.
  • Notice of material change. Anchor will give every active Therapist account at least thirty (30) days’ notice of any material change to these Terms or to subscription pricing.
  • Closure-driven deletion. Following a verified account-closure request, Anchor will delete Tenant data within thirty (30) days, subject to the retention obligations described in the Privacy Policy.

7. Private beta

The Service is currently offered as a private beta. During the beta period:

  • access is by invitation only;
  • the Service is provided at no cost to invited Therapists;
  • Anchor may end an individual beta arrangement on fourteen (14) days’ notice. In cases of serious violation of these Terms (including fraud, impersonation, or abuse), Anchor may end access immediately and without notice.

8. Pricing after beta

Paid subscription tiers will be introduced after the close of private beta. Pricing and tier details will be announced at least thirty (30) days in advance of becoming effective. Therapists who joined during private beta will be either grandfathered into the then-current free tier or offered a fair transition path; Anchor will not retroactively charge for usage during the beta period.

9. Prohibited use

You may not:

  • impersonate a licensed practitioner or misrepresent your qualifications to Clients;
  • store clinical records, diagnostic session notes, or any other category of medical record in Anchor; the Service is not built for such data and offers no clinical-grade safeguards;
  • send unsolicited marketing or bulk communications via Anchor-generated email channels;
  • attempt to access another Therapist’s Tenant, circumvent row-level security, or scrape data from the Service;
  • reverse-engineer Anchor’s private application programming interfaces or resell the Service to a third party;
  • use the Service to facilitate any activity that is unlawful under the laws of India.

10. Account closure

  • Closure by You. Email hello@tryanchor.in from the address associated with the account to request closure. Anchor will confirm receipt and proceed with deletion as described in the Privacy Policy.
  • Closure by Anchor. Anchor may suspend or close an account that, in Anchor’s reasonable judgement, violates these Terms. Anchor will provide seven (7) days’ notice in routine cases. In cases of serious violation, including fraud, impersonation, or abuse, suspension may be effective immediately.

11. Disclaimers and liability

The Service is provided “as is” and “as available”. Anchor makes commercially reasonable efforts to keep the Service running and accurate, but excludes, to the maximum extent permitted by law, all express or implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Anchor is not liable for:

  • any harm arising from a Therapist’s professional conduct, treatment decisions, or interactions with their Clients;
  • loss of income, business, goodwill, or data resulting from Service downtime, software defects, or scheduled maintenance;
  • indirect, incidental, special, consequential, or punitive damages, however caused.

Anchor’s aggregate liability arising out of or in connection with the Service in any twelve (12)-month period is limited to the subscription fees actually paid to Anchor by You during that period. During private beta, no fees are paid; aggregate liability for that period is therefore zero.

12. Indemnity

You agree to defend, indemnify, and hold harmless Anchor and its proprietor against any third-party claim, loss, demand, or proceeding arising out of or in connection with: (i) Your breach of these Terms; (ii) Your professional conduct with Clients; (iii) any tax, regulatory, or financial dispute arising from records You maintain in the Service; or (iv) Your misuse of the Service.

13. Governing law and disputes

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts at Delhi.

Before initiating formal proceedings, You are encouraged to raise the matter at hello@tryanchor.in; most disputes can be resolved more quickly through direct correspondence.

14. Changes

Anchor may revise these Terms from time to time. Material changes will be communicated by email to every active Therapist account at least thirty (30) days before becoming effective. Continued use of the Service after the effective date constitutes acceptance of the revised Terms; if You do not accept them, You should close your account before the effective date.
